This website is operated by Norelio Group Limited, trading as Wellory ("Wellory", "we", "us", or "our"). We offer products for sale to customers in the United Kingdom. Orders are fulfilled and shipped directly from Hong Kong. These Terms of Service ("Terms") govern your use of this website and any purchases you make through it.
By visiting our website and/or purchasing from us, you agree to be bound by these Terms, together with our Privacy Policy and Returns & Refund Policy. If you do not agree to these Terms, you should not use this website.
Nothing in these Terms affects your statutory rights as a consumer under the laws of England and Wales, Scotland or Northern Ireland, including, where applicable, the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the Digital Markets, Competition and Consumers Act 2024. Where any provision of these Terms conflicts with your statutory rights, your statutory rights will prevail.
SECTION 1 – ELIGIBILITY AND ONLINE STORE TERMS
By using this site, you confirm you are at least 18 years old, or the age of legal majority in your jurisdiction, and that you have the legal capacity to enter into a binding contract. You must not use our products or site for any unlawful or unauthorised purpose, nor transmit any virus, worm, or other malicious code. Breach of these Terms may result in suspension or termination of your access to the Service.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse service, subject to your statutory rights and applicable UK consumer protection and equality law (we will not refuse service on any unlawful discriminatory basis). Data you submit may be transmitted over public networks; card/payment data is always encrypted in transit and processed by our PCI-DSS compliant payment provider.
You agree not to reproduce, duplicate, copy, sell, resell, or commercially exploit any part of the Service without our express written permission.
SECTION 3 – PRODUCT INFORMATION AND ACCURACY
We take reasonable care to ensure product descriptions, images, and pricing are accurate at the time of publishing, in line with our obligations under the Consumer Protection from Unfair Trading Regulations 2008. Colours may vary slightly depending on your device display. We are not liable for minor inaccuracies that do not affect the essential characteristics of the goods, but we will correct material errors as soon as reasonably possible and will not knowingly mislead you as to a product's characteristics, benefits, or effects.
Any health, wellness, or beauty claims made about our products are for general informational purposes and are not medical advice. Where a product is a cosmetic, food supplement, or medical device, it is labelled and marketed in accordance with applicable UK regulations (including UK cosmetic product safety and food supplement rules), and any regulated claims are supported accordingly.
SECTION 4 – PRICES, VAT AND IMPORT CHARGES
All prices displayed on this website are shown in GBP (£) and do not include UK import VAT, customs duties, import taxes or any courier handling fees.
All orders are fulfilled and shipped directly from Hong Kong.
As the importer of the goods, you are responsible for paying any applicable UK import VAT, customs duties, import taxes and courier handling charges required before delivery. These charges are determined by HM Revenue & Customs (HMRC) and/or the delivery carrier and are separate from the purchase price paid at checkout.
Wellory does not collect, receive or benefit from these charges and has no control over the amounts charged.
Any applicable import charges will be clearly disclosed before you complete your purchase. We recommend checking the latest guidance published by HM Revenue & Customs (HMRC) before placing your order.
We reserve the right to change the prices of our products and services at any time. However, any changes will not affect orders that have already been confirmed and paid for.
In the event of a genuine pricing, typographical or technical error, we reserve the right to cancel or refuse the affected order. Where payment has already been received, you will be notified promptly and offered the choice of receiving a full refund or proceeding with your order at the correct price.
SECTION 5 – ORDERS AND ACCURACY OF ACCOUNT INFORMATION
We reserve the right to refuse or cancel any order, including where we suspect fraud, reseller/distributor activity, pricing errors, or a breach of these Terms. If we cancel or amend an order after payment, we will notify you and issue a full refund of any amount already charged for the cancelled portion.
You agree to provide accurate, current, and complete information when placing an order and to keep your account and contact details up to date.
SECTION 6 – YOUR RIGHT TO CANCEL (14-DAY COOLING-OFF PERIOD)
If you are a consumer ordering from the UK, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel your order within 14 days of receiving your goods, without giving any reason.
To exercise this right, you must inform us of your decision to cancel by a clear statement (e.g. email to info@wellory.co.uk) before the 14-day period expires. We will reimburse all payments received from you, including standard delivery costs, within 14 days of receiving the returned goods or evidence of return, using the same payment method you used, unless you agree otherwise.
You are responsible for the cost of returning goods unless we tell you otherwise or the goods are faulty. Goods should be returned in a condition allowing us to resell them as new, where reasonably possible; you are liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods.
Exceptions: the right to cancel does not apply to goods that are sealed for health protection or hygiene reasons (e.g. certain cosmetics, supplements, skincare) once unsealed after delivery, in accordance with the Regulations.
This right is in addition to, and does not affect, your right to reject faulty goods under the Consumer Rights Act 2015 (see Section 13).
SECTION 7 – DELIVERY
We aim to dispatch and deliver orders within the timeframes stated at checkout or on our Shipping Policy page. As orders are fulfilled from Hong Kong, delivery times may vary due to international shipping and customs clearance. Risk in the goods passes to you on delivery; legal ownership passes once we have received payment in full.
If delivery is delayed beyond a reasonable time due to circumstances within our control, you may be entitled to a refund under the Consumer Rights Act 2015.
SECTION 8 – OPTIONAL THIRD-PARTY TOOLS AND LINKS
We may provide access to third-party tools and links over which we have no control. Such tools and links are provided "as is," and your use of them is at your own risk and subject to the relevant third party's own terms. We are not liable for third-party content, products, or services, except to the extent required by applicable law.
SECTION 9 – USER COMMENTS, REVIEWS AND SUBMISSIONS
If you submit reviews, comments, or other content to us, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, and publish that content for the purposes of operating and promoting the Service. We do not compensate for submissions and have no obligation to keep them confidential.
In line with the Digital Markets, Competition and Consumers Act 2024, we do not post, commission, or incentivise fake or misleading reviews, and we will not suppress genuine negative reviews.
You agree your submissions will not be unlawful, infringing, defamatory, or contain malicious code, and you will not impersonate any person or misrepresent your affiliation with anyone.
SECTION 10 – PERSONAL INFORMATION
Your personal data is processed in accordance with our Privacy Policy and applicable UK data protection law (UK GDPR and the Data Protection Act 2018). See the Privacy Policy.
SECTION 11 – ERRORS AND CORRECTIONS
We may correct typographical errors, inaccuracies, or omissions in product, pricing, or promotional information at any time, including after an order is placed. If a genuine pricing error materially affects your order, we will contact you to confirm before proceeding, and you may cancel for a full refund if you do not wish to continue at the corrected price.
SECTION 12 – PROHIBITED USES
You may not use the site to: act unlawfully; infringe intellectual property rights; harass, defame, or discriminate against others on any protected ground under the Equality Act 2010; submit false information; transmit malware; scrape or harvest data; or circumvent site security. We may suspend or terminate your access for any violation.
SECTION 13 – YOUR STATUTORY RIGHTS AND OUR LIABILITY
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot be excluded or limited under English law.
As a consumer, you have legal rights under the Consumer Rights Act 2015 in relation to goods that are not as described, not of satisfactory quality, or not fit for purpose. These Terms do not affect those legal rights.
Subject to the paragraph above, and to the fullest extent permitted by law:
- we provide the Service on an "as available" basis and do not guarantee it will be uninterrupted or error-free;
- we are not liable for indirect or consequential losses that were not reasonably foreseeable to both parties at the time you placed your order; and
- our total liability to you for any claim arising from your order shall not exceed the total price you paid for the relevant goods, except where such a cap is prohibited by law.
SECTION 14 – INDEMNIFICATION
You agree to indemnify us against reasonable losses and costs (including legal fees) arising from your breach of these Terms or your unlawful use of the Service, except to the extent caused by our own breach, negligence, or the losses arise from your exercise of statutory consumer rights.
SECTION 15 – SEVERABILITY
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions continue in full force, and the offending provision will be replaced with a valid provision that most closely reflects its intent.
SECTION 16 – TERMINATION
These Terms remain in effect until terminated. You may stop using the Service at any time. We may suspend or terminate your access for a material breach of these Terms, without affecting either party's accrued rights and obligations (including your statutory cancellation and return rights, and any refunds owed).
SECTION 17 – ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Returns Policy, and any order confirmation, constitute the entire agreement between you and us regarding your use of the Service and supersede any prior agreements.
SECTION 18 – GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales. If you are a consumer resident in the UK, you may bring proceedings in relation to these Terms in the courts of your part of the UK (England and Wales, Scotland, or Northern Ireland), and nothing in these Terms restricts your right to do so.
Before starting formal court proceedings, we encourage you to contact us at info@wellory.co.uk so we can try to resolve the issue directly.
SECTION 19 – CHANGES TO THESE TERMS
We may update these Terms from time to time. The version in force is the one published on this page at the time you place your order. Material changes will be highlighted; continued use of the site after changes are posted constitutes acceptance for future orders, but does not affect orders already placed.
